Monongalia County judge sides with Morgantown in firefighter dispute

MORGANTOWN, W.Va. — A Monongalia County judge on Thursday ruled in favor of the city of Morgantown in its battle over holiday backpay to firefighters.

Monongalia County Circuit Court Judge Phillip Gauijot issued the summary judgment, noting the city has the authority to compensate firefighters for only 12 hours of time off during each holiday.

The International Association of Fire Fighters Local 313 brought forward the legal challenge in June 2019. The group argued the city violated state code by not paying firefighters for working 24-hour shifts.

Gaujot additionally reduced the backpay period from five years to two years.

Attorney Teresa Toriseva, who is representing the firefighter union, said she is planning to appeal the decision.
